Studio Makeland Confidentiality and Release of Liability (June 2025) Waiver of Terms of Service

Participants or their guardians must read and agree to the following waiver and terms of service before participating in any Studio Makeland programme, workshop, or activity.

Studio Makeland is a creative, peer-led space dedicated to fostering creativity, exploration, and well-being in children through hands-on projects and playful activities. While we are committed to providing a safe and supportive environment, Studio Makeland does not offer professional medical, psychological, or therapeutic advice, diagnosis, or treatment.

Studio Makeland is dedicated to taking all practicable steps to ensure the health, safety, and well-being of our facilitators, contractors, students, and participants.

Participation and Confidentiality

By enrolling in this programme/workshop, I acknowledge that the intention of Studio Makeland is to create a safe, trusting, and respectful space for all participants. I agree to:

Respect the privacy and confidentiality of all participants during and after the programme.

Maintain a safe and supportive environment by not sharing sensitive information shared during the sessions.

Parents, guardians, or caregivers of participants agree to maintain the privacy and confidentiality of anything shared by their child or other children about these sessions.

Arrival and Departure Safety

Studio Makeland is not responsible for transporting or escorting children to or from the studio. It is the responsibility of the parent, guardian, or caregiver to ensure their child arrives safely at Studio Makeland and is picked up promptly at the end of the session.

If children are walking from school to Studio Makeland, it is the caregiver’s responsibility to ensure they are safely accompanied or have safe travel arrangements.

Eating and Food Allergies

Due to the studio’s landlord policy, no eating is allowed inside Studio Makeland. Snacks or meals may only be consumed

outside in the garden area.

Studio Makeland is not responsible for managing food allergies or reactions. If your child has allergies, please: Inform Studio Makeland in advance of any known medical conditions, allergies, or dietary restrictions.

Ensure your child understands not to share food with other children if they have allergies.

We will review any disclosed medical conditions and confirm if we can safely accommodate them.

Cancellation Policy

You may withdraw from the programme at any time; however, no refunds will be issued once enrolled. Studio Makeland reserves the right to reschedule or cancel any session if needed. If a programme is cancelled by Studio Makeland, a full refund will be issued.

Confidentiality of Materials and Content

I agree not to disclose, reproduce, or distribute any materials, practices, or methods shared by Studio Makeland to third parties without prior written consent.

Studio Makeland acknowledges that any personal or sensitive information shared by participants will be kept confidential and will not be shared with third parties without prior consent from the participant (or their guardian).

Collection and Use of Personal Information

We collect personal information, including:

-Name

-Contact information (phone, email)

This information is collected solely to communicate about Studio Makeland activities and updates. We do not share this information with any third party.

Photography and Media Consent

I give my consent for Studio Makeland to take photos or videos of my child (or myself, if applicable) during workshops, classes, or events. These images or videos may be used for promotional purposes on social media and our website.

If I do not wish for images or videos of my child (or myself) to be used, I understand that I must inform Studio Makeland before the programme or workshop begins.

Safety and Well-Being/ Emergency Medical Care Consent

In the event of an emergency, I give permission to Studio Makeland facilitators to seek medical attention for my child if I cannot be reached immediately.

Assumption of Risk and Release of Liability

I acknowledge that participation in Studio Makeland’s programmes may involve inherent risks, including but not limited to minor injuries or accidents. I voluntarily assume these risks and release Studio Makeland, its facilitators, staff, and contractors from any liability for injury, loss, or damage to person or property that may occur during or as a result of participation.

Indemnification

I agree to indemnify and hold harmless Studio Makeland, its facilitators, and staff from any claims, demands, or causes of action resulting from my child’s participation in the programme.

Jurisdiction and Dispute Resolution

This waiver shall be governed by the laws of New Zealand, and any disputes shall be resolved in the courts of New Zealand.
